The Disciplinary Chamber at the Supreme Administrative Court revoked the immunity of Judge Tomasz Szmydt on Thursday, paving the way for potential prosecution on espionage charges.
Attorney General and Justice Minister Adam Bodnar announced late Wednesday that the National Prosecutor's Office had submitted a request to the Disciplinary Chamber to lift Judge Szmydt's immunity, along with seeking permission for his temporary arrest on espionage charges.
Tomasz Szmydt, a judge at the Warsaw Administrative Court, sought “protection and refuge” from the authorities in Minsk, Belarus, on Monday. He stated that he had to leave Poland because he “disagreed with the actions of the authorities in Warsaw.”
Szmydt at the Warsaw Administrative Court handled cases involving, for example, refusals to issue security clearances for access to classified information.
The proceedings are based on provisions of the criminal code concerning involvement in the activities of foreign intelligence and providing information to such intelligence that may harm the Republic of Poland. Special services are also investigating the case.
