Poland files for arrest of fugitive judge

Polish prosecutors have filed for the provisional arrest of Tomasz Sz., a judge who has defected to Belarus, the National Prosecutor’s Office (PK) announced.

On May 6, the media reported that Sz. [full surname withheld under Polish law], who had access to classified information while working in a Warsaw court, had asked for political asylum in Belarus.

Two days later, PK opened an investigation into Sz.’s alleged cooperation with a foreign intelligence service on the territory of Poland and Belarus.

At the same time, the body filed a motion with a disciplinary court at the Supreme Administrative Court (NSA) for a resolution allowing Sz. to be held accountable for any criminal act committed and for his immunity to be revoked.

It also said it would seek permission to detain and temporarily arrest Sz. on espionage allegations.
On May 9, NSA accepted Sz.’s resignation from his position, followed by a disciplinary court waiving his immunity.

On Monday, PK wrote on X, formerly Twitter, that the “prosecutor submitted a request to the District Court for the Capital City of Warsaw to apply a preventive measure in the form of the provisional arrest of Tomasz Sz.”

“Issuing a provisional arrest order is a condition for initiating a search warrant,” it added.

Sz., a former judge at the Provincial Administrative Court in Warsaw, asked the Belarusian authorities for “care and protection” in Minsk on May 6. He told a press conference in Minsk that he had been forced to leave Poland “due to disagreement with the policy and actions of the current authorities.” He claims to have been persecuted and harassed due to his independent political views.
