CJEU must decide on European law, not on political issues: Hungarian Minister

“The decision of a European Institution, especially the European Court, has to be respected. At the same time, the decision of the Constitutional Court has to be respected. For a government, the Hungarian or Polish Constitution is a line, which we have to follow, it is not a question. Therefore if there is no cooperation between the Constitution institution of the member states and the constitutional institution of the European Union \we will never find a solution,” the Hungarian politician said.

He added that CJEU does not show any free will towards Poland or Hungary. He assessed that the Court’s decision must take into account the national identity of countries.

“If we cannot find a legal solution with the European Commission, then the courts have to decide, but only in the competences of European law and not more,” he declared.

The National Fund decision of the Commission has been postponed due to Hungary’s introduction of the Child Protection Policy. The minister said that the European Commission should not take part in the national policies, but only decide on European law matters.

The Minister in relation to the current migration crisis in Europe responded that the outside border of the EU must be protected. He believes that more countries believe so in comparison to 2015.
